The fees we charge depend in part on the nature of the case. Generally speaking, however, our firm works on a contingency basis in employee benefits cases but charges up front a relatively small, non-refundable minimum charge. In addition, when we recover money for clients, clients are responsible for case costs and expenses.
A plaintiff who wins a case under ERISA is entitled to seek his attorney's fees, interest, costs, and expenses from the defendant. While there is no guarantee, in the best case, this could mean that a plaintiff would recover from the defendant the benefits he seeks, interest on the benefits, costs, expenses, and 100% of his attorney's fees.
